Westonia Gallery Gift Card (Digital) Terms and Conditions of Use

1.Agreeing to these terms and conditions

1.1 We recommend you read these terms and conditions carefully before purchasing or redeeming your Westonia Gallery Digital Gift Card. If you have any feedback or queries or would like more information about your Westonia Gallery Digital Gift Card please contact Westonia Gallery online Customer Care on 08 9046 7200.
1.2 These terms and conditions apply to all Westonia Gallery Digital Gift Cards issued by the Australian Broadcasting Corporation ABN. 88 368 575 438 on or after 5 November 2015.
1.3 Your purchase, activation, redemption or attempted redemption of a Westonia Gallery Digital Gift Card constitutes your acceptance:

(a) to be bound by these terms and conditions, Privacy Policy and all applicable laws and regulations; and
(b) not to use the Westonia Gallery Digital Gift Card in any way that is unlawful, misleading, deceptive, unfair or causes detriment to any other person.

1.4 If you give a Westonia Gallery Digital Gift Card to another person you must ensure they are aware of these terms and conditions, as well as the remaining balance and expiry date of the Westonia Gallery Digital Gift Card.

2. Buying a Westonia Gallery Digital Gift Card

2.1 Westonia Gallery Digital Gift Cards can be loaded with a balance of between$10.00 and $500.00 as chosen by you at the time of purchase at Westonia Gallery online only..

3. Using your Westonia Gallery Gift Card

3.1 Your Westonia Gallery Digital Gift Card is redeemable at Westonia Gallery online only, at westoniagallery.com.au, or when placing a phone order through Westonia Gallery online.
3.2 When you buy goods using your Westonia Gallery Digital Gift Card the value remaining on the card will be reduced by the price of the goods bought with the card.
3.3 Your Westonia Gallery Digital Gift Card may be partially redeemed. Any unused balance will remain on your Westonia Gallery Digital Gift Card for you to use at any other time before the card's expiry date. No change will be given to you in any circumstances.
3.4 Where the price of goods you want to buy exceeds the balance on your Westonia Gallery Digital Gift Card, you will be required to pay the difference between the price of the goods and the available balance using another method of payment, such credit card.
3.5 The following are the exclusions applicable to the redemption of your Westonia Gallery Digital Gift Card:

3.5.1 Your Westonia Gallery Digital Gift Card is non-refundable and cannot be redeemed for cash;
3.5.2 WESTONIA GALLERY digital Gift Cards cannot be used to purchase other gift cards or other tender.

3.6 If you are under the age of 15, your Westonia Gallery Digital Gift Card cannot be used to buy DVDs or other material classified as MA15+. If you are under the age of 18, your Westonia Gallery Digital Gift Card cannot be used to buy DVD's or other material classified as R18+.

4. Expiry of Westonia Gallery Digital Gift Cards

4.1 Your Westonia Gallery Digital Gift Card is valid for use until the expiry date, which is 12 months from the date of issue.
4.2 It is up to you to redeem the full value of your Westonia Gallery Digital Gift Card before its expiry date. Any unused balance will not be refunded or credited to you when your Westonia Gallery Digital Gift Card expires.

5. No reloading

5.1 You cannot add or reload any credit to your Westonia Gallery Digital Gift Card after it has been purchased.

6. Transaction history

6.1 You can confirm the expiry date and balance of your Westonia Gallery Digital Gift Card and your transaction history by visiting westoniagallery.com.au or by phoning 08 9046 7200.

7. Damaged, lost or stolen Westonia Gallery digital Gift Cards

7.1 Westonia Gallery Digital Gift Cards will not be replaced or returned if lost or stolen.
7.2 The WESTONIA GALLERY accepts no responsibility for the loss, theft or destruction of a Westonia Gallery Digital Gift Card and has no obligation to replace or refund value for lost, stolen or damaged Westonia Gallery Digital Gift Cards.
7.3 The WESTONIA GALLERY may prevent further use of your Westonia Gallery Gift Card if:

(a) you report that it has been damaged, lost or stolen; or
(b) the WESTONIA GALLERY believes or has reason to suspect that you have used (or will use) it in such a way that is in breach of these terms and conditions.

8. Liability

8.1 You are liable for all transactions on your Westonia Gallery Digital Gift Card, including where your Westonia Gallery Digital Gift Card has been lost or stolen.

9. Appropriate use of Westonia Gallery Digital Gift Cards

9.1 Westonia Gallery Digital Gift Cards may be used for personal or business gifts; however Westonia Gallery Digital Gift Cards must not be used in connection with any marketing, advertising or other promotional activities, without WESTONIA GALLERY prior written approval.
9.2 Use of the WESTONIA GALLERY's name or brands (other than in connection with your use of Westonia Gallery Digital Gift Cards), is strictly prohibited.
9.3 You must not use a Westonia Gallery Digital Gift Card in any way that states or implies that any person, website, business or product or service is endorsed or sponsored by the WESTONIA GALLERY.

10. Changes to Terms and Conditions

The WESTONIA GALLERY reserves the right to change any of the terms contained in these Terms and Conditions at any time where the change is required for any reason and agree to provide you with at least 30 days’ notice of such changes. We will give you notice by posting the changes on abcshops.com.au. If you write to the WESTONIA GALLERY within the notice period and do not accept the changes we may cancel your Gift Card and refund any remaining Westonia Gallery Digital Gift Card value.

11. Privacy

Our Privacy Policy explains how we handle the personal information that we may collect from you with respect to Westonia Gallery Digital Gift Cards. If you do not have a copy and are unable to access online (westoniagallery.com.au), please call 08 9046 7200 for a copy.

12. Limitation of liability

You have certain rights under the Australian consumer legislation which cannot be excluded and are not affected by these terms and conditions. Except for those statutory rights, any conditions implied by any other laws are excluded from these Terms and Conditions. To the maximum extent permitted by law, we will not be liable to you for any loss or damage (whether direct, indirect or consequential) howsoever caused, nor will we be in default under these Terms and Conditions, for failure to observe or perform any of our obligations under these Terms and Conditions for any reason or cause except if caused by our gross negligence. To the extent permitted by law, if we are liable to you, our maximum aggregate liability to you is limited to the remaining Westonia Gallery Digital Gift Card value on your card.

13. APPLICABLE LAW

These Terms and Conditions are to be construed and enforced in accordance with the laws of Western Australia, Australia. Any dispute in connection with a Westonia Gallery Digital Gift Card is exclusively subject to the jurisdiction of the courts of Western Australia, Australia (including the Federal Court of Australia,).
